CMR in line

ENGLISH law on the applicability of the CMR Convention to international road carriage has been brought into line with Belgian, Dutch and German law following the English Court of Appeal decision in "Quantum v Plane Trucking and Air France".

The appeal court, in unanimously overruling the judgment of the court of first instance, held that the CMR Convention applied to the international road leg of a multimodal contract of carriage – in this case, by air from Singapore to Paris, and then by truck and ro-ro ferry from Paris to Dublin.

The decision is reported more fully in David Martin-Clark's DMC Casenotes.
